NOTICE OF TRUSTEE’S SALE
 WHEREAS, on October 1, 2009, Johnny W. Garland and Ellen D. Garland (collectively, the “Grantors”) executed a certain Deed of Trust, Assignment of Rents and Leases, Security Agreement and Financing Statement (with Arbitration) (“Deed of Trust”) to PRLAP, Inc. as Trustee, to secure the prompt payment of certain indebtedness (“Indebtedness”) payable to Bank of America, N.A. (“Bank”), the Indebtedness being more particularly described in the Deed of Trust which is of record in the Register’s Office of Lawrence County, Tennessee, (“Register’s Office”), in Book 339, Page 56, to which reference is hereby made; and
 WHEREAS, Bank is the current holder of the Deed of Trust and the Indebtedness secured thereby; and
 WHEREAS, default has been made in the payment of the Indebtedness and in the performance of the covenants made in the Deed of Trust, by reason of which the entire balance owing thereunder has been declared to be due and payable, said default continuing; and
 WHEREAS, the aforesaid Trustee named in the Deed of Trust has been replaced by Bank by instrument recorded in the Register’s Office, under which instrument Bank has appointed M. Craig Smith, a resident of Hamilton County, Tennessee, as Substitute Trustee, with all the rights, powers and duties granted the Trustee named in the Deed of Trust;

 Situated, lying and being in the 7th Civil District of Lawrence County, adjacent to and south of Central Turnpike and adjacent to and west of Greenwood Road, in the Center Community, and described as follows:  Beginning at the center of the intersection of Greenwood Road and Central Turnpike; thence with the center of Greenwood Road, S 5 degrees W, 171.5 feet; S 2 degrees 32 minutes W, 400 feet; S 4 degrees 06 minutes E, 300 feet and S 12 degrees 23 minutes E, 586 feet to Howard Gowers most easterly NE corner; thence with Gower, S 76 degrees  17 minutes W, 578.3 feet, a stake on the south side of a small hollow; thence N 26 degrees 16 minutes W, 860 feet to the center of Central Turnpike; thence with the center of the turnpike, N 35 degrees 30 minutes E, 325 feet; N 45 degrees 23 minutes E, 399.5 feet; N 51 degrees E, 450 feet to the point of beginning, containing 19.6 acres, more or less.
 Description in accordance with a survey by J.T. Dixon, Tennessee No. 668. Dated April 23, 1985.
 Derivation clause:
 The instrument constituting the source of Borrowers interest in the foregoing property was a Warranty Deed recorded at Book 228, Page 161, in the Registers Office of Lawrence County, Tennessee which currently has an address of 392 Turnpike Road, Lawrenceburg, Tennessee, 38464.
 The property address is believed to be:

 The Deed of Trust recites title to the property as unencumbered except as provided above, but Substitute Trustee will make no covenant of seisin or warranty of title, express or implied, and will sell and convey by Trustee’s Quitclaim Deed as Substitute Trustee only, subject to (i) any governmental zoning or subdivision ordinances or regulations, (ii) any liens and encumbrances superior to the Deed of Trust, (iii) all taxes and assessments that are a lien on the property, (iv) all rights of redemption of taxing authorities, and (v) all other matters which are prior in right to the lien of the Deed of Trust.
 Further, the transfer shall be “As Is” and without warranty of any kind, express or implied, as to the condition of such property and the improvements located thereon, including merchantability or fitness for particular purpose.
 The right is reserved to adjourn the day of sale to another date and time without further publication upon announcement at the time set above and to sell to the second highest bidder in the event the highest bidder does not comply with the terms of the sale.

 SUBSTITUTE TRUSTEE'S SALE
  Default having been made in the terms, conditions, provisions and payments made and provided for in a deed of trust dated May 16, 2002, executed by Lanny R. Benefield and Cinthia Benefield, to David R.   The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Substitute Trustee, be cause for rejection of the bid, and, if the bid is rejected, the Substitute Trustee shall have the option of making the sale to the next highest bidder who is ready, willing, and able to comply with the terms thereof.  The proceeds derived from the sale of the property will be applied as provided for in said deed of trust.
